| Q | My neighbour has a tree that overhangs my garden. What are my rights? | ||
| A | You may cut off branches which overhang your property and cause you a nuisance but you must be careful not to exceed these rights and it is always prudent to inform the tree owner before doing the works. The branches you cut off remain the property of the tree owner and you should offer them back. You should take legal advice if you are unsure of you rights. Check with your local Council before doing any works to trees as some trees are protected by Tree Preservation Orders or Conservation areas and there could be severe penalties for works without proper authorisation. | ||
